Fair Deal is registered (Registration No.  ZA009995) as a data controller with the Information Commissioner for the United Kingdom.

We are the controller of the personal information that we collect from you on our website, which means that we are legally responsible for how we collect, hold and use your personal information. It also means that we are required to comply with data protection laws when collecting, holding and using your personal information.

Personal information is anything which enables us to identify you in some way. You may be asked to provide personal information through the Website. Marketing

Fair Deal is a registered charity. We will never use your personal details for any other reason other than the reasons stated. We won’t sell or pass them on to a third party for marketing/commercial reasons. We will only contact you to promote our work, events we are hosting or any other promotional activity if we have your permission to do so in advance.

Photography/Videos

We will only use your image/video on our website and social media if you have given us consent. If you no longer wish your image/video to be used, please contact:

We will do our best to delete the image/videos however please be aware it will not always be possible to trace old images/video and retrieve them from social media if they have been shared.

2. Our legal basis for processing your personal information

  • Legal and regulatory obligations which apply to us as a registered social charity and legal organisational entity

  • Our legitimate interests – while you have a legitimate interest in the protection of your personal information, we also have an overriding legitimate interest in handling and using your personal information, including sharing it with our service providers (listed in section 3 of this policy), for the purposes described in section 1 of this policy

3. Who we share it with

We may share your personal information with the following organisations for the purposes described in section 1 of this policy:

  • Our funders / local authorities who contract us to provide a service to our service users, which may include you, a family member, or someone you know
  • Partner organisations we are authorised or required by our Data Controllers to share data with for analysis and/or auditing purposes
  • organisations providing benefits advice and support
  • Police Scotland and the local authority anti-social behaviour department in relation to complaints involving anti-social or other criminal behaviour, and in the case of missing persons
  • Government (Scottish and UK) where required

4. How long do we keep it

We will only keep your personal information for as long as we need to for the purposes described in section 1 of this policy, including meeting any legal, accounting, reporting or regulatory requirements.

5. How we keep it secure

The security of your personal information is of paramount importance to us and we use technical and organisational measures to safeguard your personal information.

However, while we will use reasonable efforts to safeguard your personal information, the use of the Internet is not entirely secure and, for this reason, we cannot guarantee the security of any personal information that is transferred by or to you via the Internet. We also cannot guarantee the security of personal information shared with us via social media. We will NOT share personal information via social media. If you have any concerns about the security of your personal information, please contact our DPO for more information.

The Website may include links to other websites that are not owned or controlled by us. This privacy policy does not cover the links to third party websites located on the Website or websites accessed through any such links and any use of such website by you is at your own risk.

6. Personal information you provide about somebody else

We understand that there may be situations where you provide us with personal information about somebody else. In those situations, you confirm that:

  • The other individual has consented to you acting for them and to your use of their personal information
  • You have informed the other individual of our identity and the contents of this policy, including the purposes for which we will use that individual’s personal information described in section 1 of this policy
  • The other individual has explicitly consented to our use of that individual’s personal information for the purposes described in section 1 of this policy
